- Resolution Methods - There are a number of ways to resolve family disputes which include:
Mediation - A neutral facilitator, chosen by the parties, and aids parties in reaching an agreement. Upon resolution of the issues, the agreement is put into a contract or court order.
Arbitration - An arbitrator, chosen by the parties, hears issues and the parties' perspectives, may or may not review evidence and makes a decision for the parties which is binding.
Collaborative Law - Both parties choose a collaborative lawyer and sign an agreement to resolve their dispute without the use of litigation. If the parties wish to litigate during the process, both must choose new legal counsel.
Settlement Meetings - In this setting, both clients and their counsel meet to try to resolve issues amicably and without the use of litigation.
Judicial Dispute Resolution - In this arrangement, a Justice or a Judge acting as a facilitator meets with both clients and their counsel to help the parties reach a resolution. The process may be non-binding, meaning the parties are not obligated to reach a resolution, or binding, in which case a Justice makes a decision for the parties.
Litigation - The use of the court system to resolve disputes.
